You do not have to contact all of them. If the court receives several complaints about the same violation, the case will be consolidated. At the same time, you should not be represented by multiple law firms, as this does not improve your chances or the amount of compensation.

What are the requirements for a representative plaintiff?

The representative plaintiff must show that:

  • He/she would represent the interests of the class adequately and fairly
  • He/she has a plan for the action that would settle the claims of the class and that the class members have been notified of the action plan.
  • He/she does not have an interest that is in conflict with the other class members on the common issues.

Definition:
An agreement made between counsel for plaintiffs and defendants during or after a settlement negotiations on the claims of a class whereby the defendant agrees not to object to a fee request of the counsel representing the plaintiff class.

Intervention

Definition:
A person who is not originally named as part of the party to the litigation can intervene and seek approval to join the suit. Absent class members don?t have to intervene to share in any settlement, however.

Representative plaintiff

Definition:
A person named in a class action litigation as the plaintiff as contrasted with ?absent? class members who are not individually named, but are only the class by virtue of the class definition.
